ANISA Pro Program Terms & Conditions

PLEASE READ CAREFULLY. By participating, you agree to the following rules governing the ANISA Beauty Pro Program, including, where permitted, binding arbitration in the event of any disputes involving your purchase or participation. You need not join to purchase products at www.anisabeauty.com or any other online or retail location.  IF YOU DO NOT AGREE WITH THESE RULES, PLEASE DO NOT ENROLL.

1. OVERVIEW OF THE ANISA BEAUTY PROGRAM: The program is provided by Anisa Beauty. LLC and its affiliates (“Anisa”) through which qualified individuals (a “Member”) receive discounts when purchasing products on anisabeauty.com.
2. GENERAL MEMBERSHIP GUIDELINES: Membership in the program is voluntary. You need not join to purchase products www.anisabeauty.com or any other online or retail location. Membership is nontransferable. Products purchased with the membership discount are for personal and professional use and may not be resold under any circumstances. The membership discount may not be combined with any other offers. By enrolling in the program, Member agrees to these Terms, rules, regulations, policies, and procedures of the program (the “Terms”) and the website of use, as may be in force and published at Anisa's website and as may be changed at any time without notice. Communications about the program, including any changes, will be communicated by email or online at anisabeauty.com.  Membership in the program and its benefits are offered at the discretion of Anisa. Anisa, may, at any time terminate, change, limit, modify or cancel the program or any rules, regulations, benefits or conditions of participation by posting the modified rules at www.anisabeauty.com.  Your continued membership in the program after such posting will constitute your acceptance.
3. ELIGIBILITY: The program is open to residents of the fifty (50) United States, 18 years of age or older at the time of registration, who are professional and/or licensed cosmetologists/estheticians, or students who provide and maintain a valid email address and provide all required documentation.

   To enroll, applicants must submit an application and upload one of the following:

   1. Professional business website providing at least 10 photos of your own original artistry work on different clients as well as offering makeup services;
   2. Call list on production company letterhead dated within the last 6 months;
   3. Editorial page & publication cover dated within the last 6 months;
   4. Proof of enrollment in beauty school, such as confirmation letter/email of class enrollment or class schedule (documents must indicate name and date of enrollment);
   5. Professional license (cosmetology, esthetician);
   6. Union Card; or
   7. IMDB Credit

   Or two of the following:

   1. Business card with name and specific profession;
   2. Professional letter of employment or pay stub from client, salon manager, or cosmetic retailer;
   3. Completed contract dated within the last six months; or
   4. Makeup Artistry course certificate 
4. ENROLLING IN THE PROGRAM: The program is available to professional cosmetologists/estheticians or students. To apply, go to: Anisa Pro Program to complete and submit an online application. The application is free to complete.
   1. To enroll, you must provide your full name, mailing address, email address, phone number and professional credentials. Websites must be complete with galleries of your work done on a variety of clients with several styles of makeup. Social media sites, beauty blogs, booking websites, and cosmetic reselling sites are not accepted.
   2. A scan or photo of a physical business card will qualify. No digital business cards will be accepted. Course certificates may be for online or in-person courses that require more than 80 hours of study. We reserve the right to ask for proof of hours studied.

   Enrollment will be confirmed with a welcome message at the email address provided. One (1) account per person and per email address. The person who is the authorized email account holder of the email address indicated when registering is deemed to be the Member.

5. PROGRAM BENEFITS: Program benefits are as follows:
   • Membership period begins upon application acceptance and may require renewal.
   • Members receive a twenty-five percent (40%) discount on ANISA Beauty purchases. Up to five (5) of the same product may be purchased per order. Orders that do not meet these conditions will be canceled.
   • Discount excludes items marked as sale, clearance, or new on anisabeauty.com and cannot be applied to previous purchases or used with any other promotion.
   • Spotlights on ANISA Beauty’s social media platforms.
   • Sneak peek on new product launches.
   • Opportunities to partner with ANISA Beauty.

   Program benefits apply solely to purchases made on www.anisabeauty.com. Purchases at ANISA Beauty counters in retail stores, pharmacies or other third-party retailers and other online retailers are not eligible.

6. PROGRAM OFFERS AND PURCHASES
   1. Purchases will post to your program account approximately 72 hours from purchase date, delivery date, shipment date or retailer purchase upload date. Discounts are based on dollars spent on qualifying purchases or other qualifying behaviors.
   2. Anisa reserves the right to change the discount percentage for purchases at any time during the program
   3. Anisa may make offers selectively available to members, based on purchase activity, geographic location, program participation, or other factors.
   4. From time to time, Anisa may also provide members with an opportunity to earn additional benefits through participation in site activities, such as watching videos, posting reviews/uploading user content (“User Content”) in social media.
7. DURATION OF MEMBERSHIP: All applicants are subject to approval and require renewal. Members provide all necessary information and documentation. In the event the program is terminated early, Member’s ability to use discounts will end.  Anisa will advise Member of any change in program timing by email or by posting the updated Terms on the website.
8. USER CONTENT: While Members are encouraged to post comments regarding Anisa, such posts are not required. If, however, Members choose to post comments regarding Anisa Beauty, you must follow these rules:
   1. Must be at least 18 years old, the sole author and owner;
   2. Must disclose any material connection to Anisa including receipt of free product samples for review purposes or other compensation or affiliation;
   3. Must represent your sole opinion and must be true and accurate;
   4. Must have permission from any other person(s) featured in your submission;
   5. Must not infringe on any patents, trademarks, trade secrets, copyright, right of publicity, privacy right or other right of any party;
   6. Must not include any information that references other websites or personal information such as addresses, email addresses, contact information, phone numbers, credit card information, etc. For you or anyone else that can be used to track, contact or impersonate that person;
   7. You grant Anisa, and its affiliates, a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use any intellectual property ("IP") content that you post like photos and videos;
   8. All "moral rights" that you may have in the user posting has been voluntarily waived by you.
   9. Because Anisa does not review the substance of Member postings on Anisa social platforms or other communications, every Member must be careful in dealing with other Members to avoid fraud. Member acknowledges that information provided by other Members may, despite the prohibitions set forth in the Terms of Use, be harmful, inaccurate or deceptive. Authentication of the true identity of Internet users is difficult, and so Anisa cannot and does not confirm that each Member is the person who they claim to be. 
9. RETURNED PURCHASES: If an item is returned, the returned dollar amount will be added back to your quarterly account balance. Returns shall be processed in accordance with the https://www.anisabeauty.com return policy available at /pages/Returns.
10. ACCOUNT ACTIVITY
    1. Each Member is responsible for ensuring the accuracy of his/her account and should check his/her account regularly. Each Member is responsible for ensuring that the mailing address and the email address associated with his/her account is accurate and up to date.  Changes to an account or account information may only be made by the Member to whom the account belongs. Anisa is not responsible for any incorrect or inaccurate information supplied by any Member participating in the program.
    2. Upon termination of a membership/account for any reason, account balance will be deleted.
    3. Memberships/accounts cannot be transferred to another person.
11. DUPLICATE ACCOUNTS
    1. Only one account per person per email address. In the event of a dispute over ownership of an account, the registration will be declared to have been made by the authorized account holder of the email address submitted at the time of enrollment. For purposes of these Terms, the "Authorized Account Holder" is the natural person who is assigned to the submitted email address by an internet provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.
    2. If more than one (1) account is assigned to an individual, or if an individual opens more than one (1) account, Member will only receive benefits for one (1) account. Duplicate accounts will be canceled.
12. INACTIVE ACCOUNTS
    1. Anisa reserves the right to deactivate an account in which Member acted in fraudulent or unsportsmanlike activity or technical failures of any kind.
    2. In the event an account is inactive for any given 365 day period, the Member’s account will be deactivated, including forfeiture of any earned benefits. Inactivity is defined as no purchases made on www.anisabeauty.com. In order to reactivate an account a Member must reapply to the program.
13. MEMBERSHIP CANCELLATION: you may cancel your membership in the program at any time by submitting your request to pro@anisabeauty.com or support@anisabeauty.com.
14. COMMUNICATION: As a Member, you agree to accept and receive communications from Anisa or Anisa’s third-party service providers, including via email, text message, and calls, to the mobile phone number you provided to Anisa in your Application. You may opt-out of the marketing emails at any time, but operational emails will still be sent to you as it relates to your Membership in the program.  Examples of these are: the welcome email, a program confirmation email, a monthly account update email, or other communications that help us to ensure that your account is monitored.  Text messages or calls may be sent or made using an automatic telephone dialing system or other technology. Message frequency may vary. Message and data rates may apply. You may opt out of receiving text messages at any time by replying “STOP.”
15. GENERAL PROGRAM CONDITIONS AND EXCLUSIONS
    1. Artwork, photography, and logos, including those for Anisa used in conjunction with the program, on this website or in print are copyrighted intellectual property of Anisa Beauty, LLC. These materials may not be reproduced, replicated or doctored in any manner. All other material, including text, photos, and design, is copyright to Anisa Beauty, LLC and may not be reproduced elsewhere without explicit written permission. All sales and marketing brochures are to be used as reference only and not to be duplicated, printed or reproduced for commercial use.
    2. Anisa reserves the right to cancel, suspend and/or modify the program, or any part of it, if there is any evidence of virus, worms, bugs, non-authorized human intervention, or any fraud, technical failures or any other factor beyond Anisa’s reasonable control impairs the integrity or proper functioning of the program, as determined by Anisa in its sole discretion. Anisa reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the registration process or the operation of the program or to be acting in violation of these Terms and conditions or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the offer may be a violation of criminal and civil law, and, should such an attempt be made, Anisa reserves the right to seek damages (including attorneys’ fees) from any such person to the fullest extent permitted by law. Anisa’s failure to enforce any term of these Terms and conditions shall not constitute a waiver of that provision.
    3. By enrolling in program, you agree to provide true, accurate, current and complete information about yourself and maintain and promptly update the information to keep it true, accurate, current and complete. If you provide any data that is untrue, inaccurate, not current or incomplete, or if Anisa, in its sole discretion, suspects that your registration data is untrue, inaccurate, or incomplete or that you are in any way abusing your membership in the program, Anisa reserves the right to suspend, terminate or refuse your participation.
    4. Discounts are not valid unless earned in strict compliance with the requirements set forth and intended by Anisa and Member shall not attempt to earn discounts by any means (including without limitation, by using any script, bot, data mine or other automated means) that only simulates applicable requirements. In the case of a dispute regarding the quarterly balance available to any Member, Anisa’s unilateral decision shall be final. Upon termination of membership for any reason, all program benefits will be forfeited and Anisa will not provide cash equivalent for program benefits.
    5. By enrolling in program, you agree not to (a) take any action or (b) upload, post, submit or otherwise distribute or facilitate distribution of any User Content (including text, communications, software, photographs, videos, sound recordings, data or other information) using any communications service, discussion forum, or other feature available on or through program, in any manner, that is unlawful, deceptive, misleading, fraudulent, threatening, abusive, harassing, libelous, invasive of another's privacy, tortious, obscene, profane, infringes on any patent, trademark, trade secret, copyright, right of publicity, right of privacy, any other right of any party or which otherwise violates Anisa’s Terms and conditions or any other agreement.
    6. You further agree not to (a) upload any content that imposes an unreasonable or disproportionately large load on Anisa computing, storage or communications infrastructure, or attempts to gain unauthorized access to the service, other accounts, computer systems or networks connected to the service, through password mining or otherwise; (b) contains software viruses or any other computer codes, files, or programs that are designed or intended to disrupt, damage, limit or interfere with the proper function of any software, hardware or network system or to damage or obtain unauthorized access to any system, data or other information of Anisa, or any third party; (c) creates Member accounts by any automated means or under false pretenses or impersonates any person or entity, including an employee or representative of Anisa; (d) harvests, scrapes or collects any information from anisabeauty.com.
    7. Anisa is not responsible for any incorrect or inaccurate information supplied by members while participating in the program.
    8. Program is not transferable in the event of death or divorce and does not constitute property of member.
16. Use of Materials Created/Provided By Anisa.  All rights, title, and interest in the materials and content created by Anisa including Anisa’s name, logo, and any other trademarks (Anisa Material) are owned by Anisa. 
17. Grant of Rights: Members agree and hereby grant to Anisa and its designees, successors, licensees, and assigns an unlimited, perpetual, irrevocable, assignable, royalty-free, fully paid-up license to reproduce, distribute, create derivative works of, edit, alter, display, exhibit, combine with other materials, exploit, and otherwise use any content created and/or posted pursuant to the Anisa Pro Program (and agrees to waive all moral rights thereto), and all elements embodied therein, in whole or in part, in any manner and in any and all media now known or hereafter devised (including on Anisa’s website and social media pages) throughout the universe for any purpose whatsoever, including, without limitation, for commercial purposes, without compensation or notification to, or permission from, entrant or any third party.
18. RELEASE: By participating in the program, each Member agrees to release and hold harmless Anisa and its respective parents, affiliates, suppliers, distributors, advertising/promotion agencies, and offer suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the "released parties") from and against any claim or cause of action, including, but not limited to, losses or damages of any kind, including personal injury, death, or damage to or loss of property, arising out of participation in the offer or receipt or use or misuse of any product or coupon.
19. LIMITATION OF LIABILITY: THE ANISA IS NOT RESPONSIBLE FOR INCORRECT OR INACCURATE TRANSCRIPTION OF INFORMATION, FOR PROBLEMS RELATED TO ANY OF THE EQUIPMENT OR PROGRAMMING ASSOCIATED WITH THE PROGRAM OR UTILIZED BY THE MEMBER, FOR ANY HUMAN ERROR, FOR ANY INTERRUPTION, DELETION, OMISSION, DEFECT, OR LINE FAILURE OF ANY TELEPHONE NETWORK, CELLULAR NETWORK, OR ELECTRONIC TRANSMISSION, FOR PROBLEMS RELATING TO COMPUTER EQUIPMENT, SOFTWARE, INABILITY TO ACCESS THE WEBSITE OR ONLINE SERVICE, OR FOR ANY OTHER TECHNICAL OR NON-TECHNICAL ERROR OR MALFUNCTION. IN THE EVENT OF A PRINTING ERROR OR IRREGULAR PACKAGING, NEITHER ANISA NOR RESPECTIVE RELATED COMPANIES, PARENTS, SUBSIDIARIES, AFFILIATES, AND RESPECTIVE AGENTS AND THEIR AGENCIES, SUPPLIERS AND OTHER COMPANIES INVOLVED IN THE DEVELOPMENT OR EXECUTION OF THE PROGRAM OR THE PRODUCTION OR DISTRIBUTION OF PROGRAM MATERIALS ("RELEASEES") SHALL HAVE ANY LIABILITY. UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL ANY OF THE RELEASEES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE PROGRAM OR MERCHANDISE OFFERED THROUGH THE PROGRAM, EVEN IF ANY OR ALL OF THE FOREGOING OR ANY OF THEIR AUTHORIZED REPRESENTATIVES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF THE ANISA IMPROPERLY DENIES A MEMBER ANY DISCOUNT, LIABILITY WILL BE LIMITED TO THE EQUIVALENT VALUE OF DISCOUNT. BY PARTICIPATING IN THE PROGRAM, A MEMBER WAIVES ANY AND ALL RIGHTS TO BRING ANY CLAIM OR ACTION RELATED TO SUCH MATTERS IN ANY FORUM BEYOND ONE YEAR AFTER THE FIRST OCCURRENCE OF THE KIND OF ACT, EVENT, CONDITION OR OMISSION UPON WHICH THE CLAIM OR ACTION IS BASED. ANISA, ITS OFFICERS, DIRECTORS, EMPLOYEES, PROMOTION AGENCIES, AGENTS, SUCCESSORS, ASSIGNS, AND SERVICE PROVIDERS, ARE NOT RESPONSIBLE FOR ANY PRODUCTS OR SERVICES OFFERED BY THE REWARDS PARTNERS. TO THE FULLEST EXTENT ALLOWABLE BY LAW, ANISA, ITS JOINT VENTURES, OFFICERS, DIRECTORS, EMPLOYEES, AND THEIR PROMOTION AGENCIES SPECIFICALLY DISCLAIM ANY REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE PRODUCTS AND/OR SERVICES OFFERED BY ANY REWARDS PARTNER, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE AND IMPLIED WARRANTIES ARISING FROM COURSE OF DEALING OR COURSE OF PERFORMANCE. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU. MEMBERS AGREE TO RELY SOLELY ON THE MANUFACTURER'S WARRANTIES, IF ANY, FOR ANY PRODUCTS REDEEMED THROUGH THIS PROGRAM. BY PARTICIPATING IN THE ANISA DISCOUNT PROGRAM, EACH MEMBER HEREBY RELEASES THE RELEASED PARTIES FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, LOSSES, LIABILITIES, AND OTHER EXPENSES (INCLUDING, WITHOUT LIMITATION, ATTORNEY’S FEES) RELATING TO THAT MEMBER’S PARTICIPATION IN ANISA REWARDS, USE OF POINTS OR REWARDS, OR AGREEMENT TO THESE TERMS. ANISA IS NOT RESPONSIBLE FOR REQUESTS OR CORRESPONDENCE LOST OR DELAYED IN THE MAIL.
20. ARBITRATION/CHOICE OF LAW: This program and these Terms will be governed by and construed under the substantive laws of the State of Georgia, without reference to conflict-of-laws considerations. Anisa and Member each agree that any dispute, claim, or controversy arising from or relating to this program and these Terms or Member’s program membership will be exclusively and finally resolved by binding arbitration conducted under the rules of the American Arbitration Association and held at the AAA regional office in Fulton County, Georgia. Anisa and Member each acknowledge and agree that each has chosen arbitration rather than litigation to resolve any such dispute, claim, or controversy. Anisa and Member each understand that a judgment on any arbitral award may be entered in any court having jurisdiction.  No arbitration under this program and these Terms will be consolidated with any other arbitration.
21. PRIVACY: Your privacy is important to us. Enrollment information collected by the program is subject to our Privacy Policy.
22. POLICY UPDATES: We may update this policy at any time and any changes will be effective immediately upon the publication of revisions. We encourage you to review our Privacy Policy periodically.
